Ald. Wilder stated the petitioner did everything she was supposed to do based on the current laws.  She stated there is a statute that says these businesses only need to have 10 parking spaces.  Ald. Wilder asked how Council could change the ordinance so that it doesn't affect the citizens.  City Manager Melder stated that there was an allowance in these districts for establishments under 3,000 square feet to be exempt from parking requirements.

Ald. Miller Blakely asked if that was something they voted on. (A City Council, not this City Council.)  She also asked how many other businesses that came before them or previous Councils were denied the opportunity because there was no adequate parking.  Ald. Miller Blakely stated that if the Council has put these kinds of ordinances and zoning requirements in place, then we should be adhering to what we are putting in place.  It seems like every time somebody comes with a special use permit request that circumvents what we put in the policy.  Ald. Miller Blakely stated she just wanted to see equity across the board when folks come for privileges.

Mayor Johnson stated the Council could always say no, but he thinks the Council always wants the flexibility in some cases to be able to decide the merits of that on a case-by-case basis and not necessarily by staff, which is why the special use permit process is before us.  Folks have to abide by the rules that are in place when they submit an application.

17. Petition of C. Scott Burns of Coastal Engineering & Consulting, on behalf of the Property Owner, Mehul Sheth with DM Investment Holding, LLC, for a Future Land Use Map Amendment from Transportation/Communication/Utilities to Traditional Commercial for 3.12 acres at 815 Wheaton Street (20033 12033) in Aldermanic District 2 (26-004033-ZA)

Speaker(s):

  • C. Scott Burns, petitioner

 Ald. Wilder moved to close the zoning hearings for agenda items #17 and #18, seconded by Ald. Leggett.  The motion passed unanimously, 9-0-0.

Ald. Wilder asked if a note/recommendation be added to state that the development is going to be for housing and nothing else.   Mayor Johnson stated that the traditional commercial does allow for additional uses.  City Manager Melder also responded.  Ald. Wilder expressed that there is a lot of movement in that area, and they do not want to clog that area up with any business that is not going to be conducive to what is going on in the community.  She asked what are the special uses.

Mayor Johnson stated that the down-zoning was absolutely preferable to anything else we would want over there under the light-industrial.  So, it is definitely an improvement.  Mayor Johnson stated it may be preferable if staff takes an opportunity to look at this and come up with some recommendations based on what the Council thinks about this.  City Manager Melder stated the staff's recommendation is in line with MPC's recommendation, which is that the traditional commercial uses are very appropriate for this corridor.

Ald. Wilder stated she was supportive of the downsizing, but she wants to make sure that this is not the classic switch and bait.  She expressed that the Council wanted to assure that the petitioner adheres to the initial plan.  Ald. Wilder asked the petitioner the following questions:

  • When was the petitioner going to start doing anything to move on that particular lot? (If it gets approved, then the petitioner would move forward with coming up with the design.)
  • How many acres? (3.1 acres).
18. Petition of C. Scott Burns of Coastal Engineering & Consulting, on behalf of the Property Owner, Mehul Sheth with DM Investment Holding, LLC, for a Zoning Map Amendment from I-L (Light Industrial) to TC-2 (Traditional Commercial-2) for 3.12 acres at 815 Wheaton Street (20033 12033) in Aldermanic District 2 (26-003931-ZA).

Ald. Wilder asked City Manager Melder the following questions:

  • Why are we paying more?
  • What was the scope?
  • What was the synergy with what is going on there?

Ald. Wilder stated she was personally asking for accountability when we do these types of scopes.  She stated clearly that the windows, whether you try to save them or not, are within our funding.  However, it is always the perception of whether it is price gouging or not; so we want to make sure the public knows that we understand we have to do better.
