Description Don Dyches, the attorney representing Joseph Monroe, has requested the City grant an access easement to benefit property located at 1400 Canal Bank Road. The easement would provide access across the Savannah Ogeechee Canal and link Mr. Monroe’s property to Little Neck Road. There is already an earthen driveway within the proposed easement area that is used by Mr. Monroe to access his property. However, there is no formal easement document granting those rights and this has created a title issue associated with the planned sale of the property. Mr. Dyches provided documentation and a claim that the property has been in the Monroe family for generations and their access across the canal predates the City’s ownership of that canal (which occurred in 1915). Given these circumstances, City staff have negotiated a settlement with Mr. Dyches to avoid litigation, and that settlement involves conveyance of a limited driveway easement in exchange for payment of an administrative fee of $5,000.
The matter has been reviewed and approved by Real Estate Services and the City Attorney. | |
