Description

St. Joseph’s/Candler Health System, Inc. (SJCHS) (Petitioner), has petitioned the City to acquire a portion of Brazil Street (formerly known as William Street). This section of Brazil Street is not asphalt paved and separates the campus of Candler Hospital from additional properties recently acquired. The Petitioner wants to acquire the unpaved right-of-way and consolidate all the properties within their campus.

OCGA 32-7 provides authorization for the Mayor and Council to declare unneeded Right-of-Way (ROW) surplus and available for sale to adjoining property owners so they may assemble it with their adjoining properties and develop that property to its highest and best use. There is only one adjoining property owner other than SJCHS. Proper notice was given to the other abutting property owner inquiring of their interest in buying a portion of the subject ROW but staff did not receive a response.

A third-party appraiser was retained and determined fair market value (FMV) of this vacant ROW to be $130,000. SJCHS has agreed to this purchase price and understands they will be responsible for all closing costs associated with the proposed real estate transaction. The sale would benefit the City by reducing maintenance costs and generating sale proceeds to the general fund. The sale would also provide a public benefit by allowing SJCHS to consolidate and grow their hospital/health care campus. Also requested is authorization for the City Manager to execute all associated closing documents.
