Approval of Development Agreement with HP Ogeechee Road LLC for Hillpoint Multifamily Development.This is for water and sewer services for a proposed multi-family residential development located within the City of Savannah Water and Sewer Georgetown/Gateway Service Area. Description

HP Ogeechee Road, LLC is developing 45.86 acres of property in unincorporated Chatham County that is located on Ogeechee Road and the property is generally bounded by Southwest Middle School to the east, Abercorn Street to the north, the Georgia Botanical Gardens to the west, and Ogeechee Road to the south.  The Property is currently zoned P-B-C (Community – Business) and the Developer will be filing a zoning petition to permit multifamily development on the Property.This property is in the City of Savannah’s Water and Sewer Area in Unincorporated Chatham County and is served thru a past municipal intergovernmental agreement between the City of Savannah and International Paper Realty Corporation.  For this property to be served by the City of Savannah Water and Sewer, the property owner agrees to pay an ANNUAL fee in lieu of taxes (PILOT) equal to the taxes that would be paid if they were within the City of Savannah City Limits.  Presently the existing location of this property does not allow annexation into the City of Savannah at this time and the terms of this Agreement are contingent upon the Developer applying in good faith to annex its Property into the City of Savannah.  The Developer and the City will work in good faith and use their best efforts to annex the properties as described in the Agreement.  The Developer desires certain commitments from the City of Savannah with respect to extending and making additions to the existing City water and sanitary sewer systems to serve the Project.  The City of Savannah City Attorney’s office have reviewed and approved this Development Agreement, including the annexation requirements and the payment-in-lieu-of-taxes (PILOT).
