This motion is to approve a resolution which authorizes the City Manager to execute and deliver the First Amendment to Infrastructure Repair Agreement. The City entered into an Infrastructure Repair Agreement dated January 19, 2017 (the “Infrastructure Agreement”) with the prior owner of the Savannah River Landing/Eastern Wharf property, and this agreement was assigned to the current owner, SRL Land Venture LLC (the “Owner”), on September 20, 2017. Since that time, the City staff and the Owner have continued discussions and negotiations on the details of the Infrastructure Agreement, and the City and the Owner now desire to amend and modify that agreement to expand the scope of work to be performed by the Owner to include certain streetscape improvements and to provide for additional City funding from certain designated streetscape funds to cover the cost of such additional streetscape work.

Attached is a copy of the proposed First Amendment to Infrastructure Repair Agreement, with exhibits, together with a copy of the original Infrastructure Repair Agreement.
