45. Motion to Rezone 1032 Mohawk St from RSF-20 to RMF-2.24 (Petitioner: Harold Yellin for Sunrise Acquisitions LLC)

The Mayor and Aldermen approved this request after a Zoning Hearing at the October 10, 2019 Regular City Council Meeting.  The action being considered today is the approval of an Ordinance for the rezoning of the subject properties.

Harold Yellin for Sunrise Acquisitions LLC, Petitioner, (File No. 19-003923-ZA) is requesting approval of a rezoning map amendment for properties located at 1032 Mohawk Street (3.79 acres on PIN(s): 20783 01014 & 015) from its existing R-6 (Single-family Residential – 6 units per net acre) Zoning District to the P-R-M-24 (Planned Residential-Multi-family - 24 units per net acre) Zoning District.

The 3.79-acre property is currently undeveloped.  The requested rezoning is consistent with the Future Land Use Category of General Residential as designated in the Comprehensive Plan's Future Land Use Map.

On August 27, 2019, the Planning Commission voted to recommend approval of the request to rezone the subject property from R-6 to P-R-M-24.

However, on July 18, 2019, the Mayor and Aldermen rezoned the property from R-6 to RSF-20 (Residential Single-family - 20), effective September 1, 2019.  Therefore, the request is to rezone the property from RSF-20 to RMF-2.24 (Residential Multi-family 2 - 24 units per acre).

The petitioner has agreed to rezone the property to the RMF-2.24 since Sec. 1.1.11 allows the developer to choose between the old and new Zoning Ordinances.

Article 1 Sec. 1.1.11 Effective Date:

The Effective Date of this Ordinance is September 1, 2019.

However, between September 1, 2019 and February 28, 2020, a developer shall have the option to elect that their development be governed by this Ordinance or the previous ordinances in effect immediately before the Effective Date of this Ordinance. To qualify for this election, a developer shall submit a complete application as provided in Section 3.1.5 for their development at the time of election and no later than February 28, 2020.


Rezone the property to the alternative RMF-2.24 Zoning District.
