Title 34. Approval of An Easement for 5.4 Acres of a Closed Landfill for an Equipment Laydown Area | |

Description MacAljon Industries petitioned the City for additional land at the former landfill between U.S. 17 and the Chatham County Detention Center, just west of Chatham Parkway. MacAljon owns the adjoining property and since 2014 has used about two acres of land at the landfill as a laydown area for equipment storage under a Revocable License Agreement. Under the agreement, MacAljon has cleaned rubble from the landfill and rocked and compacted the area, and uses the area for laydown of equipment. MacAljon would prefer an easement to restate its use of the land and an additional area of about 2 acres, for a total of 5.43 acres, including an access road, to expand the capacity of the laydown area. The former 150-acre landfill is in an EPD-approved post closure plan and has no use otherwise. Based on estimates provided by David Keating, Director of Real Estate Services, MacAljon has agreed to pay $50,000 payment for the value of the easement and to maintain the entry road that serves the closed out landfill and the Police Department Gun Training Range. MacAljon agrees to pave the entry to the road at least once every 15 years. The City Attorney's Office has reviewed the easement and concurs as to its legal form. | |
