Title 42. A Resolution to Extend a Temporary Stay on the Issuance of Any New License or Permit Related to the Sale and/or Distribution of Medicinal Cannabis for Period of an Additional 180 Days.
Strategic Priority Good Government
Description In 2015, Governor Deal legalized medicinal cannabis, and Governor Kemp expanded on the legalization in 2019 when he signed the Georgia’s Hope Act. This legislation permits the manufacturing and dispensing of low-THC oil within Georgia. At this time, no business is focused on selling the product within our community. However, it is anticipated that interest will be forthcoming as this industry expands. While Georgia has a statewide commission over licensing, the City’s current Zoning Ordinance does not include medical cannabis. On March 24, 2022, the City approved a 180-day stay to allow for the development of appropriate public safety plans and zoning criteria to ensure that dispensaries will not compromise the public health, safety, and general welfare of our citizens. An additional 180-day stay is proposed to allow for additional public input and monitor State licensing procedures related to this use. Only dispensaries licensed by state may sell low-THC oil in Georgia. It is a violation of state and federal law for unauthorized businesses or persons to sell any form of cannabis.
