Description Petitioner, Michael Roach on behalf of the Forum Group, is requesting to encroach into City Right-of-Way with the construction of the Starland Village Project. Those encroachments include building footings, awnings, stoops and stairs, and drainage encroachments. The proposed encroachment requests do require and have received a Certificate of Appropriateness from the Metropolitan Planning Commission. The petition has been reviewed by Development Services, Public Works and Water Resources, Development Services, Greenscapes, Planning & Urban Design, Sanitation, Fire, Police, and Real Estate Services and is recommended for approval subject to the following conditions: 1. Stormwater structure shall remain private and property owner shall be responsible for all operation, maintenance, repairs, and replacement of same. 2. Water and sewer infrastructure is within close proximity of the area. Prior to construction, it shall be incumbent upon the property owner to properly locate same and prepare for review and approval by the City and adjustments, relocations, and/or protections of water and sewer facilities.
