Description The petitioner is requesting approval of a Special Use Permit to operate a restaurant with onsite consumption of alcohol at 410 E. 37th Street. The Zoning Ordinance requires a Special Use Permit for any restaurant with on premises consumption of alcohol within the TC-1 (Traditional Commercial-1) zoning district. The property is approximately 0.08 acres and located at the northwest corner of the intersection of Price Street and East 37th Street. The historic building was constructed in 1927 and is a contributing resource within the Thomas Square-Streetcar National Register Historic District and the local Streetcar Historic District. The service station was originally constructed as a Gulf Service Station prototype. Additions date from 1954-1973. In February 2021, a Certificate of Appropriateness (COA) (File No. 21-000661-COA) was approved by the Historic Preservation Commission to rehabilitate the structure. In February 2023, a six-month extension to the COA was granted. The petitioner intends to rehabilitate the building into a small restaurant with pre-packaged food items, sell convenience store items with locally made products, and provide outdoor seating. The request is specifically for beer and wine sales only.
