New Cingular Wireless PCS, LLC (“AT&T”) currently pays an annual rental rate at $56,946.63 for placement of telecommunication equipment on the City’s tower at 1801 Kerry Street. The tenant is seeking to upgrade equipment at the lease premises.

Based on negotiations and consultations with the City's GMA telecommunications consultant, the Tenant has agreed to an increased monthly base rent amount of $1,000.00, equating to $12,000.00 per year. Annual rental rate effective upon installation will increase to $68,946.63. No other terms or conditions will change.

This 4^th Amendment to Lease has been reviewed by the City’s Information Technology Department (IT) and by Real Estate Services. The following condition(s) are noted:

• Equipment installation is in accordance with approvals and attached as Exhibit A-3 to the 4^th Amendment.
• Equipment installation shall be coordinated with the City’s IT Department.
