Description
The petitioner, Faith Progressive Primative Baptist Church, owner of 3212 Bee Road, Savannah, GA (PIN 2-0084 -09-004), has requested the City declare surplus and sell an unopened right-of-way (R/W) bisecting their parcel. O.C.G.A. 36-37-6 provides authority for the City to declare R/W suplus which is no longer needed for public road purposes and to sell this land to adjoining property owners. In addition, Section 6-105 of the Charter Provision of the Code of City Ordinances states sales of surplus R/W may be sold for such compensation as the Mayor and Aldermen deem reasonable and just.
The petitioned R/W is +/- 40 feet wide and +/- 200 feet long thus comprising +/- 8,000 square feet. The assessed value of the adjoining lands is $6.00 per square foot equating to an estimated value of $48,000. The church has been maintaining and using the R/W for years, and sale of the R/W will reduce liability and maintenance costs to the City. Considering these factors, staff recommends a 50% discount to yield a sale price of $24,000.
Staff recommends this R/W be declared surplus and sold to Petitioner, and the City Manager authorized to execute a Quit Claim Deed and any associated closing documents.
