Description Harold Yellin and Joshua Yellin as Agents for Montgomery Street Partners, LLC, (File No. 18-002953-ZA) are requesting approval to rezone two parcels (PINs 2-0066 -10-008 and 2-0066 -10-009) located at the corner of West 32nd Street and Martin Luther King, Jr. Boulevard from B-G (General Business) to TC-2 (Traditional Commercial, Mid-City District). The properties, comprising a total of 0.25 acres, are currently vacant and undeveloped. MPC staff determined that rezoning the subject properties to the proposed TC-2 zoning district would bring the site into the Mid-City local historic district and would promote a development pattern, apply development standards and allow specific uses that would be compatible with the surrounding neighborhood. To remain B-G would allow for more intensive commercial, and some light-industrial uses to be permitted in a redeveloping area that is currently attracting multifamily and retail/commercial land uses. The TC-2 district would also allow for more residential units to be located within the corridor and would encourage neighborhood and community-serving uses to be established in close proximity to residential uses. On June 21, 2018, the Planning Commission voted to recommend approval of the petition to rezone the subject properties from B-G to TC-2. If approved by the Mayor & Aldermen, an amendment to the Zoning Ordinance (File No. 18-003702-ZA) is required to amend the boundaries of the Mid-City District in Sec. 8-3199. The Zoning Hearing for said amendment is tentatively scheduled for August 2, 2018. βββOn April 12, 2018, the Mayor and Aldermen adopted an amendment to the Zoning Ordinance (File No. 18-000495-ZA) to amend the boundaries of the Mid-City District, and amend the TC-2 Zoning District in order to eliminate the maximum ground floor area and rear yard setback requirements within a specific area. This amendment applies to TC-2 properties located within the block, which includes the subject parcels. On April 12, 2018, the Mayor and Aldermen also approved the rezoning to TC-2 (File No. 18-000496-ZA) of six parcels located within the same block as the subject parcels. At that time, the two subject parcels, along with a third parcel (421 West 31st Street) at the corner of West 31st Street and Martin Luther King Jr. Boulevard, were left out of the request. The petitioner has since acquired the two subject parcels. If the rezoning is approved, 421 West 31st Street will be the lone parcel in the block that is not zoned TC-2. The purpose for rezoning these properties is to develop a multifamily apartment building with onsite parking and ground level commercial uses on the block. | |
