Description Petitioner Daniel Murphy, owner of real property located at 1410 East Broad, has requested a 0.039-acre portion of adjoining City-owned unopened right-of-way (ROW) be declared surplus and available for sale. Mr. Murphy currently owns the sole adjoining parcel and intends to incorporate the City land into his larger site for buffer and beautification. According to State law, surplus ROW must be offered for sale first to adjoining property owners so they can assemble such lands with their adjoining properties for highest and best use. A third-party appraiser has determined fair market value (FMV) of the property to be $28,178. The site is encumbered by an anchored guy wire to support and adjoining Georgia Power Company (GPC) electric pole. The property will be sold under the condition that the City first conveys an easement to Georgia Power Company (GPC) for this guy wire prior to selling the land to Mr. Murphy. Mr. Murphy has agreed to this encumbrance and the parties have negotiated a sale price of $24,000 given these conditions. | |
