Description

Petitioner, Jason Hagen, on behalf of Vaden Automotive Group (Vaden) has petitioned to have a portion of City right of way (ROW) declared surplus and available for sale. The requested ROW is a section of a service frontage road at 10421 Abercorn Street (in front of the Vaden Nissan automotive dealership).

Georgia Code 32-7 provides authorization for municipalities to dispose of surplus ROW “which is no longer needed".  Such property is offered first to adjoining property owners.  City Code 6-105 also authorizes the Mayor and Aldermen to sell surplus ROW to adjoining property owners.

Vaden is requesting 12,197 square feet (or .028 acres) of ROW be declared surplus and available for sale. The owner plans to redevelop the ROW as part of an auto dealership. An appraisal was performed and the owner has agreed to pay the resulting fair market value of $320,000 to the City.

The petition has been reviewed and approved by Development Services, Public Works and Water Resources, Greenscapes, Planning and Urban Design, Sanitation, Fire, and Real Estate Services. The owner has worked with Stormwater Management and has come to agreement on a plan to re-route current infrastructure and the City will reserve any necessary utility easements. In addition, the owner has committed to improving Magnolia Street, located directly south of the parent parcel, in order to bring the street up to City standards. Lastly, modifications to the traffic pattern along Abercorn Street, as a result of the site redevelopment, have been approved by the Georgia Department of Transportation.

Further request authorization for City Manager to execute deed and associated closing documents.
