Recommend approval of Contract Amendment No. 1 in the amount of $125,000.00 for additional professional liability insurance coverage with Perkins + Will.

The original contract was for design services for the new arena.  This amendment is needed to provide supplemental professional liability coverage.  When the City issued its RFP for the arena design, a minimum of $2 million in professional liability coverage was required for the design firms working on the project.  This limit is the standard in professional liability coverage for City projects. However, the City’s insurance consultant advised that for a project of this complexity and magnitude, the major consultants should have a minimum of $4 million in professional liability coverage.  The lead designer and most of the major subcontractors already carry the requisite coverage, but two local subcontractors responsible for major work on the project do not carry $4 million in coverage.  This amendment will provide the supplemental professional liability insurance needed to bring these subcontractors into compliance with the insurance consultant's requirement.

The original contract was approved by Council on June 21, 2018 in the amount of $8,820,000.00.

The total amount of this contract to date, including this amendment is $8,945,000.00.
