44. Authorize the City Manager to Execute a Fifth Amendment to Existing Lease between the City (Landlord) and New Cingular Wireless PCS, LLC d/b/a AT&T Mobility Corporation (Tenant).

Description

New Cingular Wireless PCS, LLC (“AT&T”) currently leases space on the City’s radio tower at 1801 Kerry Street and pays an annual rental rate at $81,822.57. AT&T is seeking to upgrade equipment at the lease premises and has agreed to pay an increased rental rate of $93,822.57. This 5th Amendment to Lease has been reviewed by the City’s Innovation & Technology Services (ITS), Real Estate Services, and City Attorney’s Office. The following condition(s) are noted:

  • Equipment installation is in accordance with approvals and attached as Exhibit A-4 to the 5th Amendment.
  • Equipment installation shall be coordinated with the City’s Innovation & Technology Services.
