27. Authorize the City Manager to Approve a Temporary Construction and Access Easement Agreement with Duke Realty Limited Partnership. This easement will assist the City with construction of a new force main and upgrades to Lift Station 166, which is located in the Highlands.

Description

The City’s Water Sewer Planning and Engineering Division plans to undertake construction of the Lift Station # 166 Upgrades and Force Main Replacement Project and has requested temporary use of a portion of private property along Jimmy Deloach Parkway (PIN 20981 01018) owned by Duke Realty Limited Partnership (Duke). The Public Project will upgrade and improve sewer services in the area. Duke has agreed to allow the City temporary use of a 0.2275-acre portion of their property for consideration of $2,000 for a term of one year. This Temporary Construction Agreement has been reviewed and approved by Real Estate Services, Stormwater, Water Sewer Planning & Engineering, and the office of Assistant City Attorney Shearouse. Additionally, authorization is requested for the City Manager to execute associated closing documents.
