Description City files reflect that you possess a license to sell alcoholic beverages at the Montgomery Market, situated at 4305 Montgomery Street. At the request of the Savannah Police Department, the Mayor and Aldermen directed this office to provide you with official notice that a hearing to show cause why your alcoholic beverage license should not be revoked will occur on Thursday, April 25, 2019 at 2:00 p.m. in the Council Chambers in City Hall. More particularly, and without limitation, your establishment failed an underage operation on June 20, 2018 when one of your employees furnished alcohol to an underage purchaser. Approximately four months later, on October 30, 2018 a shooting occurred, which damaged your premises. Your employees denied any knowledge of the incident, which was contradicted by video surveillance and other evidence obtained by the Savannah Police Department the following day. Then, on February 21, 2019, your establishment failed an underage operation for the second time. Public records also reveal disorderly and unlawful behavior occurring in and around your business. The foregoing events constitute serious violations of the Alcoholic Beverage Ordinance or 2017, including Section 6-1220(a), which prohibits the sale of alcohol to any person under the age of 21 and Section 6-1207(b)(7), which imposes a duty on a licensee and its employees to promptly report any breach of the peace or altercation occurring in or adjacent to a licensed premises. Accordingly, the City considers your establishment a public nuisance and intends to take appropriate action to the extent authorized by the City Code. See City Code Sections 6-1207(b )(I) and (9). To that end, at the April 25th meeting you will be required to show cause why your alcoholic beverage license should not be revoked. You may be represented by counsel at the hearing, and you and/or your attorney will have an opportunity to cross-examine all witnesses and to examine any evidence presented. | |
