Description

The petition from Anthony Abbott (Owner/Agent) requests to rezone the eight parcels located at 1025, 1029, 1033, 1037, 1041, 1045, 1054 and Lynes Avenue (PINs 20632 01014, -015, -016, -017, 20631 02018, -019, -020, -028) from the I-L (Light Industrial) zoning district to the I-H (Heavy Industrial) zoning district. The subject parcels are currently undeveloped.

With the adoption of NewZO on September 2019, these parcels were rezoned from I-H to I-L. Due to the existing development pattern of the industrial park, they were most compatible with the I-L zoning district. The current regulations and intent of the I-L zoning district is to allow a wide range of research and development, light manufacturing, warehousing and wholesaling activities in a clean and quiet manner which will not be a nuisance to nearby non-industrial uses.

The Petitioner listed proposed land-uses on the application that are already permitted in the I-L zoning district and compatible with the intent of the zoning ordinance.  The MPC also found that the possible uses permitted within the I-H zoning district could potentially be a detriment to the area and not in keeping with its surrounding character.

Recommendation

On December 15, 2020, the Planning Commission recommended denial the petitioner’s request to rezone 1025, 1029, 1033, 1037, 1041, 1045, 1054 and Lynes Avenue (PINs 20632 01014, -015, -016, -017, 20631 02018, -019, -020, -028) from I-L Zoning District to the I-H Zoning District.
