Motion to Approve Petition 170287 to Clear Title Issues Related to Lift Station Site
Description

Harris Martin (petitioner), an attorney with Bouhan Falligant, representing Brian Morrissey (property owner) has petitioned the City to clear a title issue affecting a parcel of land located in the Nettles Industrial Park subdivision.   

In 1990, a plat was recorded and a deed granted conveying a lift station site in the Nettles Industrial Park subdivision to the City. In 1991, the developer revised the subdivision plat and reduced the land area of the lift station site. The re-plat was signed by the City Engineer and recorded, but a deed was not conveyed. Therefore, petitioner is requesting the City grant a quit-claim deed to revise the size of the lift station to reflect the size as shown on the re-plat.   

The adjoining property owner has already installed a driveway and portions of a retention pond on the lift station site, and the Bureau of Public Works and Water Resources has determined the City needs to retain some of the requested property. Therefore, a resolution was negotiated with the petitioner whereby the City will retain the part it needs for the lift station, and the City will convey the small, irregular-shaped remnant parcel to the property owner. See attached exhibit for details.
