Description The petition of Jeremy Hammonds for Underdog Brewing on behalf of J. Scott Vaughn is for a Special Use Permit to operate a microbrewery in an existing commercial structure at 120 E. 42nd Street (PIN 20074 10009). A microbrewery is defined as a “facility involved in the creation of malt beverages that produces fewer than 15,000 barrels per year.” A microbrewery is permitted in the TC-1 zoning district through the provision of a Special Use permit which must be granted by Council. The subject property is located in the TC-1 (Traditional Commercial-1) zoning district which was established to ensure the vibrancy of historic mixed-use neighborhoods with traditional development patterns characteristic of Savannah during the streetcar and early automobile eras. The district provides for commercial areas that are developed at a mass and scale harmonious with nearby residential neighborhoods. Restaurants are a permitted use in the TC-1 zoning district, yet a special use permit is needed to sell alcohol from restaurants in this zoning district. The subject property is in the Streetcar Historic District and is developed with a vacant commercial warehouse on the north side of East 42nd Street, between Abercorn Street and Drayton Street. The area includes primarily nonresidential uses including convenience stores, offices, restaurants, and retail. Both the zoning classification and the land use designation are compatible with the proposed special use. Recommendation Based upon the criteria for a special use permit, the Planning Commission recommends approval of the petition from Jeremy Hammonds for Underdog Brewing on behalf of J. Scott Vaughn for a Special Use Permit to operate a microbrewery at 120 E. 42nd Street (PIN 20074 10009) with the condition that the permit is non-transferrable.
