Title
49. Authorize the City Manager to Execute a Non-Exclusive Easement for Ingress and Egress Along the Savannah Ogeechee Canal to Landlocked Parcel at 157 Telfair Road. (PIN 20714 06001)
Strategic Priority
Neighborhood Revitalization
Description

Jefte Flores (Property owner) has requested an Access Easement for Ingress and Egress across the City-owned Savannah-Ogeechee Canal to his landlocked property at 157 Telfair Road. Generally, the City seeks to avoid granting easements or other encroachments across the canal unless no other viable access is available to a property. In this case, no other practical access to his property exists. If approved, the 20-foot-wide access easement would be revokable, non-exclusive, and would allow the grantee to improve the access solely with porous materials such as sand or gravel. The Grantee acknowledges and agrees to accommodate any future trail or other recreational use of the Canal Right-of-Way proposed by Chatham County, the City, or the Savannah/Ogeechee Canal Society’s Master Plan. The easement would terminate if another route of legal access to Telfair Road is established.

An appraisal was procured from a well-qualified, MAI-designated appraiser and fair market value is deemed to be $23,517. If approved, this value would serve as the purchase price for the easement. The City will retain ownership to the underlying land and retain non-conflicting rights. It is also requested that the City Manager be authorized to execute any associated closing documents.
