46. Motion to Approve Revocable License Encroachment Agreements for the Broughton Street Streetscape Improvement Project and Authorization for the City Manager to Execute

Description

The City of Savannah has completed the comprehensive planning and design services for the Downtown Streetscape Improvement Project to include Broughton Street from Martin Luther King Jr. Boulevard to East Broad Street. The project builds on previous planning efforts to revitalize downtown Savannah and create an environment that contributes to its livability and the economic vitality.

The pre-construction phase for these improvements as presented in the design concepts developed by EDSA is currently under way. During this process, several encroaching subterranean basements were identified. To bring these encroachments into compliance with City standards, a Revocable License Encroachment Agreement (RLEAs) will be requested from each property owner with a basement located within the City's rights of way (below the sidewalk) prior to construction.

This process will consist of the impacted property owner granting access to the basement of impacted buildings to enable the City to take photos of existing conditions. Additionally, the City has a structural engineer to perform a visual structural review of the existing basement. No structural or seismic analysis is part of the assessment.

A report will be prepared summarizing the findings and will include a list of any deficiencies observed and any items that do not currently comply with the governing building code. The structural assessment will be shared with the property owner, and will provide the City with information needed to proceed with construction. Property owners are responsible for their basements, and will provide the City will indemnity and liability protections. If any future damage claims to the basements are made against the City as a result of the streetscape project, then the condition assessment reports will be referenced.
