Description Petition #180021 requests the City-owned right-of-way located north and south of 61 Graham Avenue (PIN 2-0023-18-001) between Graham Avenue and Hudson Street be declared surplus and made available for sale. The petitioner, Todd Naugle of Lott Barber, representing Cardinal Capital Management, Inc. and Vanguard Developers, proposes to develop this property within the Hudson Hill neighborhood. Currently, the petitioner is under contract with the Land Bank Authority to purchase 61 Graham Avenue and desires to incorporate all or part of this 0.85-acre right-of-way in its intended development of senior housing and a medical clinic. Vanguard Developers previously completed a similar development called Sustainable Fellwood. Cardinal Capital Management is in the process of developing a large-scale residential project within the Bayview neighborhood. This petition has been reviewed by Public Works and Water Resources, Development Services, and Real Estate Services. Public Works and Water Resources has expressed concerns regarding the southern strip of right-of-way containing both sanitary and storm sewers. After meeting with the Petitioner, both parties are in agreement that no transfer of ownership will occur unless the petitioner provides an acceptable plan to either re-locate or protect these utilities. Georgia Code O.C.G.A 32-7-4 states that the City is able to declare surplus un-needed right-of-way and offer it for sale to abutting landowners of that property. If declared surplus in accordance with Code, staff will contact adjoining property owners and give them the opportunity to acquire it. Fair market value will be established and utilized for negotiations with property owners. All of the rights-of-way must be acquired so no remnant parcels remain. | |
