21. Authorize The City Manager To Execute A Contract Modification No. 3 For Energy Performance Owner's Representative Consulting Services With 2KB Energy Services in the Amount Not to Exceed $166,913. The City solicited for Owner’s Representative consulting services in 2022 to assist with the selection of a firm to conduct an Investment Grade Energy Audit (IGEA) of City facilities, support the execution of those IGEA activities, and negotiate and execute a Guaranteed Energy Savings Performance Contract (GESPC) if ultimately pursued by the City. This extension is needed to maintain access to 2KB's critical expertise during this highly technical execution and implementation phase. (Real Estate Services)

Description

This Contract Modification No. 3 is for energy performance Owner’s Representative services with 2KB Energy Services in the amount of $166,913. The City solicited for Owner’s Representative consulting services in 2022 to assist with the selection of a firm to conduct an Investment Grade Energy Audit (IGEA) of City facilities, support the execution of those IGEA activities, and negotiate and execute a Guaranteed Energy Savings Performance Contract (GESPC) if ultimately pursued by the City. This extension is needed to maintain access to 2KB's critical expertise during this highly technical execution and implementation phase. 

These energy conservation measures, and the associated guaranteed energy savings, will reduce the City’s energy use and operating costs and demonstrate leadership in the energy efficiency space in support of the City’s clean energy goals.

The original contract for 2KB was approved by the City Council on May 12, 2022, in the amount of $161,480 for the Sustainability/Real Estate’s GESPC. Contract Modification No.1 was approved on May 25, 2023, in the amount of $199,654 (specifically for the Water Resources’ Project). Contract Modification No. 2 was approved on April 25th, 2024, in the amount of $37,205 (specifically for Sustainability/Real Estate’s GESPC) as the original vendor, Johnson Controls, was replaced with McKinstry due to lack of alignment, extending the timeline of the energy audits and scoping. Modification No. 3 is requested (specifically for Sustainability/Real Estate’s GESPC) to extend 2KB’s consultation during the implementation of the guaranteed energy savings performance contract with the current vendor, McKinstry. The scope will cover the approximate 12-month implementation period and the following first 12-month savings-performance period.  The total amount to date, including this modification is $565,252.
