Motion to Consider a Rezoning Request for 1.03 Acres Located at 2803 Limerick Street from P-B-H District to a P-B-G* (MPC Reference File 16-005546).
Description

The petitioner, Phillip McCorkle, as agent for 31 North Real Estate Investors, LLC/Michael C. Bowen, is requesting a rezoning to change the designation of the property from a P-B-H (Planned Highway Business) district to a P-B-G* (General Commercial) district. The request is tied to a general development plan under the provisions of section 8-3031(D)(1)(a), which would require approval of the general development plan by the Mayor and Alderman. The property, 45,000 square feet, is located at 2803 Limerick Street. The rezoning is being requested to allow the use of a mini storage warehouse without the requirement of being located on a collector street.

Mini storage warehouses are permitted in the property's existing P-B-H zoning district. However, P-B-H has a requirement that mini storage warehouses be located on collector streets. Limerick Street is a local street and the Zoning Board of Appeals denied the petitioner's variance request to this standard. The proposed zoning district of P-B-G* allows mini storage warehouses without the requirement of being located on a collector street. Therefore, the project could move forward on Limerick Street without a variance if the rezoning is granted.

This rezoning and corresponding Future Land Use Map amendment requests were originally heard by the Planning Commission on November 22, 2016. MPC staff felt B-G was inappropriate for this location and recommended denial. The Planning Commission also recommended denial. The petitioner requested that the rezoning petition and Future Land Use Map amendment not move forward to City Council.

On March 27, the petitioner asked to move the rezoning and Future Land Use Map amendment requests forward to City Council. MPC staff and Planning Commission continue to recommend denial. 

Recommendation

The Metropolitan Planning Commission recommends Denial of the petitioner's rezoning request due to the following findings:

  • The proposed zoning district would permit uses that would adversely impact adjacent properties.
  • The proposed zoning district would permit uses that would generate a type of traffic mix that is incompatible with the surrounding land use.
  • The proposed zoning district would permit development that is inconsistent with the comprehensive land use plan.
