Motion to Amend the Short-term Vacation Rental Ordinance to Include Rental Use Conditions and Capping System
Description

City Council heard the first reading of this ordinance during the meeting of August 31, 2017.

On August 8, 2017, the Metropolitan Planning Commission approved the growth management aspects of the short-term vacation rental report addressing zoning; specifically the short-term vacation rental use conditions. One recommendation pertaining to the transfer of property title and the need to obtain a short-term vacation rental certificate was not included as a zoning amendment in MPC's recommendations, as it was determined that this aspect was not zoning related.

An amendment to the Short-Term Vacation Rental Ordinance [Part 8, Planning and Regulation of Development, Chapter 11, Section 8-10012] is now needed to incorporate this aspect of STVR rental use conditions and capping system.

Since the August 31 first reading, the language in Sec. 8-10012 (b) and (c) was revised to provide clarity on the capping system, though the intent of the initial language was not changed. An addition was made to Sec. 8-10012 (d) to include the 1-R, 2-R and 3-R zoning districts. Please referred to attached documents for changes.
