Description

Petitioner, Jason Hagen, on behalf of JJL, Inc. (associated with Vaden Automotive Group) has petitioned to have a portion of City right of way (ROW) declared surplus and available for sale. The requested ROW fronts 10421 Abercorn Street, which is currently home to a Vaden Nissan automotive dealership. Georgia Code 36-37-6 governs the disposition of ROW and authorizes municipalities to sell and convey right of way which is no longer needed for public road purposes. All sales of surplus ROW are offered first to the adjoining property owners. JJL, Inc. is the sole adjoining property owner in this case.

The area of ROW requested in the petition is 12,197 square feet (0.28 acres) and includes part of an Abercorn Road frontage road. The owner plans to expand the car dealership to include this additional land. Staff procured an appraisal which reports the appraised fair market value at $320,000. The petitioner has agreed to pay this amount for the property.

The petition has been reviewed and approved by Development Services, Public Works and Water Resources, Greenscapes, Planning and Urban Design, Sanitation, Fire and Real Estate Services. The owner has worked with Stormwater Management on a plan to re-route current infrastructure at the Buyer's expense, and the City will reserve any necessary utility easements.

Request approval to declare the petitioned ROW surplus and available for sale to the adjoining property owner for appraised market value, and authorization for the City Manager to execute a deed and associated closing documents.
