30. Motion to Approve Intergovernmental Agreement Concerning Reimbursement of Relocation Costs for Water and Sewer Facilities in County-owned Rights of Way

Description

The City owns and operates water and sewer lines and other facilities in some of the unincorporated area of Chatham County in order to service unincorporated area residents, per an agreement with the County. Many of these facilities are located in County-owned rights of way. The facilities sometimes need to be relocated in order to accommodate road or sidewalk projects in the County. City and County staff have agreed on a formula for payment of the cost of these relocations going forward, subject to approval of the Mayor and Aldermen and the County Commissioners.

Attached is an intergovernmental agreement under which the parties agree that if a City-owned water and sewer facility in a County right of way must be relocated to accommodate a County project, the cost will be allocated as follows:

a. If the project is funded by County Special Service District funds, then the City will pay the full cost.

b. If the project is funded by any other source, including SPLOST, then the City and County will split the first $100,000 of the cost, and the balance will be paid by the County out of the project budget.
