41. Motion to Amend the Parks and Playgrounds Ordinance: Identifying, Recognizing, and Designating Property Subject to the State Recreational Property Act

Description

Purpose: It is the purpose of this section to identify, recognize and designate, without limitation, property within the City that is available to the public for recreational purposes as that term is defined by and within the meaning of the state Recreational Property Act, O.C.G.A. § 51-3-20, et seq.,as amended.

Recreational Property. All parks, squares, open and green spaces, cemeteries, marinas, docks, community center facilities, nationally registered historic places, nationally registered historic districts and all other areas, whether developed or undeveloped, lawfully utilized by any member of the public for recreational purposes, whether or not specified herein, are hereby designated recreational properties. For purposes of this section, all sidewalks, parking lots, tree lawns, vegetation and points of access adjacent to or otherwise servicing recreational properties shall be considered integral to and encompassed within each such recreational property designation. Without limitation, the following locations shall be considered recreational properties:
