Robert L. McCorkle, III for Classic Development Company LLC, Petitioner, (File No. 19-004404-ZA) is requesting approval of a rezoning map amendment for properties located at 4504 Ogeechee Road (9.14 acres on PIN(s): 20873 01020) from its existing I-L (Light Industrial) and P-B-G (Planned General Business) Zoning Districts to the R-M-40 (Residential-Multi-family - 40 units per net acre) Zoning District. 

On September 17, 2019, the Planning Commission voted to recommend approval of the request to rezone the subject property from P-B-G/I-L to R-M-40.

However, on July 18, 2019, the Mayor and Aldermen rezoned the property from P-B-G/I-L to B-C (Community Business), effective September 1, 2019.  Therefore, the request is to rezone the property from B-C to RMF-2.40 (Residential Multi-family 2 - 40 units per acre).

The petitioner has agreed to rezone the property to the RMF-2.40 since Sec. 1.1.11 allows the developer to choose between the old and new Zoning Ordinances.

Article 1 Sec. 1.1.11 Effective Date:

The Effective Date of this Ordinance is September 1, 2019.

However, between September 1, 2019 and February 28, 2020, a developer shall have the option to elect that their development be governed by this Ordinance or the previous ordinances in effect immediately before the Effective Date of this Ordinance. To qualify for this election, a developer shall submit a complete application as provided in Section 3.1.5 for their development at the time of election and no later than February 28, 2020.

The attached Concept Plan is just a concept, ONLY, of what might be developed on the property.

Rezone the property to the alternative RMF-2.40 Zoning District.
