36. Approval to Authorize the City Manager to Exchange Real Property to Facilitate Maintenance Access to the Bilbo Canal.

Description

Staff is seeking to acquire additional access for maintenance of the Bilbo Canal in the Eastern Wharf area. The City proposes to exchange street right-of-way (ROW) for the additional canal maintenance lands. No cash will be exchanged. Briefly, the City is seeking to acquire from PMC-SRL LLC:

  • Fee simple title to ROW #1 - 0.004 acres (157 square feet)
  • Fee simple title to ROW #2 - 0.001 acres (31 square feet), and an
  • Easement – 0.040 acres (1,738 square feet).

The parcels are shown in yellow on the attached plat. Total lands to be acquired are 0.045 acres (1,926 square feet). The appraised value of this property is $49,161.

In exchange, the City proposes to declare surplus and trade 0.007 acres (375 SF) of City-owned right-of-way located on Geo Meyer Avenue at the northeast portion of the Eastern Wharf area. The City will retain an easement over portions of this surplus right-of-way. The appraised value of this property is $7,998.

Georgia code O.C.G.A. 36-37-6(c) provides the City with authority to exchange real property for real property so long as the value of the real property acquired is equal to or greater than the value of the real property being conveyed; with said values to be established by appraisal. Further, request authorization for the City Manager to execute deeds and any associated closing documents.
