Description

Barbara Zinn (Agent) on behalf of John Galik (Owner) is requesting approval of a Special Use Permit to establish a veterinarian's office (Animal Services, Indoor) at 111 and 113 West Anderson Street (PINs 20066 07025 and 20066 07024).  As outlined in Sec. 3.10 of the Zoning Ordinance, the special use permit process includes consideration by the Planning Commission and then the Mayor and Aldermen. Additional conditions, restrictions and safeguards may be imposed by Mayor and Aldermen on the special use approval to protect public health, safety and welfare.

The subject properties are located between Barnard Street and Whitaker Street in the Metropolitan Neighborhood. The parcels total 0.24 acres and is developed with a single-story building and parking lot that was previously a dentist’s office. The property is within the TN-1 zoning district. In the TN-1 and TN-2 zoning districts, Animal Services, Indoor shall be permitted as a Special Use with the following conditions:

  1. Animal Shelters and Kennels shall be prohibited;

  2. The use shall be located along collector or arterial roads as defined and as identified in Appendix A-1. In the TN-2 Zoning District the use shall only be located on a corner lot;

  3. The use shall only operate between the hours of 7:00 am– 6:00 pm Monday through Saturday. Surgeries, outdoor pet runs, and boarding shall be prohibited; and

  4. Residential uses on the parcel or in the building are prohibited while operating as an “Animal Services, Indoor” use.

The Special Use Permit provisions of the Zoning Ordinance are designed to allow the reviewing authorities to consider the establishment of uses in zoning districts, where the use may be appropriate but should not be allowed by right. In review of the standards, it appears that the subject property and proposed use meet the requirements.

Recommendation

The Planning Commission recommended approval of the petition of Barbara Zinn (Agent) for John Galik (Owner) for a Special Use Permit to allow the use “Animal Services, Indoor” for 111 and 113 West Anderson Street (PINs 20066 07025 and 20066 07024).
