Description

Daniel Murphy has petitioned the City to declare surplus, a dead-end section of unopened and unimproved right-of-way (ROW) on the eastern end of the intersection of East Broad Street and 31st Street. The petitioner owns the adjacent property to the north and would like to purchase the property from the City for beautification. The property is small and comprises approximately 1,681 square feet (.04 acre); subject to survey. The site is wooded and encumbered by a large Georgia Power transmission pole and aerial lines.

Georgia Code 32-7 and City Ordinance 6-105 provide authorization for the Mayor and Aldermen to declare Right-of-Way (ROW) surplus and available for sale to all adjoining property owners so they may assemble it with their adjoining properties and develop with highest and best use. The sales price of the land would be established by an appraisal from a well-qualified, MAI-designated appraiser. The purchaser(s) will be responsible for all costs associated with the proposed real estate transaction. The sale would benefit the City by reducing maintenance costs and generating sale proceeds to the general fund.

Development Services, Greenscapes, Planning and Urban Design, Public Works and Water Resources and Real Estate Services have reviewed and approved the request.

Request authorization to offer this dead-end section of unopened and unimproved ROW to adjacent property owners at appraised value, and authorization for the City Manager to execute a quitclaim deed and associated closing documents.
