11. Motion to Approve the Inn Special Use Request at 5715 Skidaway Road (Petitioner: Harold Yellin for Colleen Smith)

Description

The Mayor and Aldermen approved this Special Use request following a zoning hearing at the April 26, 2018 City Council Meeting.  The action being considered now is the approval of an ordinance for the Special Use.

The petitioner, Harold Yellin as Agent for Colleen Smith, is requesting approval of a Special Use (Inn) within a PUD-IS (Planned Unit Development-Institutional) zoning district for property located at 5715 Skidaway Road, which is located in Aldermanic District 3 (File No. 18-001339-ZA).

The property was rezoned in 1978 from R-6 to the PUD-IS Zoning District without any conditions.  Conditions were placed on the property in 2004, 2013, and 2015 for the prior three Special Use Ordinances.

A recent site visit to determine the locations of the 2010 Bona Bella Ave duplex units and discussion with the Director of Operations resulted in the following changes to the Draft Ordinance:

  • Allowing 2 duplex buildings (4 units: Units 13-16, which are the northern duplex units north of "The Clubhouse" in Unit 17) to be live-work and/or office units;
  • Allowing 2 storage buildings that were placed on the property after 2013 to remain (Across driveway from Units 15-16);
Recommendation

Approval of an Ordinance that does the following:

  1. Include the Planning Commission’s recommendation to require an onsite, 24/7 manager (already being provided in Unit 2);
  2. Indicate that the each of the residential duplex units contain 1 bedroom each, as presented on the 2013 GDP;
  3. Allowing 2 duplex buildings (4 units: Units 13-16, which are the northern duplex units north of "The Clubhouse" in Unit 17) to be live-work and/or office units;
  4. Allowing 2 storage buildings that were placed on the property after 2013 to remain (Across driveway from Units 15-16);
  5. Replace the 2004, 2013, and 2015 Special Use Ordinances with an updated Special Use Ordinance that includes all of the relevant conditions;
  6. As the Building Official has concerns with the structures on the property, require that those concerns be properly addressed with the issuance of Certificates of Completion or Occupancy.
