COUNCIL REGULAR MEETING

June 6, 2019 – 2:00 p.m.

The Regular Meeting of Council was held at 2:03 p.m. in Council Chambers of City Hall.  Following the Pledge of Allegiance, which was recited in unison, Mayor Pro Tem Bell introduced the Pastor of St. Philip Monumental AME Church, Reverend Dr. Bernard Clarke, to offer the invocation.

APPROVAL OF AGENDA
1. Motion to Adopt the Agenda for the June 6, 2019 City Council Regular Meeting

Mayor Pro-Tem Bell moved to adopt the Agenda for the June 6, 2019, City Council Regular Meeting as amended below, Alderman Durrence seconded.  The motion carried unanimously.

  • Item #10 - Continue to June 20 Meeting - Motion to amend the 2019 Revenue Ordinance of the City of Savannah Article Y, Section 30 to Incorporate Changes to the Alcoholic Beverage Ordinance.
  • Item #11 - Continue to June 20 Meeting - Motion to amend the 2017 alcohol beverage ordinance of the City of Savannah Code part 6, Chapter 1, Article H.
  • Item #12 - Continue to June 20 Meeting - Motion to approve the Bona Fide Coin Operated Amusement Machine Ordinance.
  • Item #13 -  Amend to allow beer and extend hours from 10pm to 11pm - Motion to amend the Zoning Ordinance regarding nonconforming uses at 321 Habersham Street (Petitioner:  Robert L. McCorkle for Fox and Fig, LLC).

2. Motion to Approve the Summary/Final Minutes for the City Council Work Session and City Manager's Briefing of May 9, 2019

Mayor Pro-Tem Bell moved to approve Items #2 and #3, Summary Final Minutes for the City Council Work Session and City Manager's Briefing and  Summary Final Minutes for City Council Meeting of May 9, 2019 (with one vote), Alderman Johnson seconded.  The motion carried unanimously.

3. Motion to Approve the Summary/Final Minutes for the City Council Meeting of May 9, 2019

Mayor Pro-Tem Bell moved to approve Items #2 and #3, Summary Final Minutes for the City Council Work Session and City Manager's Briefing and  Summary Final Minutes for City Council Meeting of May 9, 2019 (with one vote), Alderman Johnson seconded.  The motion carried unanimously.

Mayor Pro-Tem Bell moved to authorize the Mayor to execute an Affidavit and a Resolution for an Executive Session held pertaining to Litigation and Personnel, Alderwoman Shabazz seconded.  The motion carried unanimously.

PRESENTATIONS
4. Moment of Silence Honoring for the 12 Victims of the May 31, 2019 Shooting in Virginia Beach, VA

A moment of silence honoring persons who risked their lives in connection with D-Day and the 12 victims of the May 31, 2019, shooting in Virginia Beach, Virginia.  PRESENTED.

5. Presentation by the Historic Savannah Foundation of a Historic Preservation Award for Factors' Walk

5A.  Recognition of Alderman Johnson for 15 years of Service with the City of Savannah.  PRESENTED.

6. Appearance by Savannah State University President, Dr. Cheryl Dozier, to Receive a Proclamation Recognizing Her Accomplishments and Retirement

ALCOHOL LICENSE HEARINGS
7. Motion to Adopt a Resolution Extending a Temporary Stay on the Issuance of Alcoholic Beverage Licenses within Portions of Aldermanic District 1 and 5

Alderwoman Shabazz moved to approve Item 7 for an additional 45 days, Alderman Johnson seconded.  The motion carried unanimously.

8. Motion to Approve Revisions to the Alcohol Density Overlay District Ordinance (Article O) (Zoning Hearing)

Mayor DeLoach opened item #8 (Zoning Hearing).  There were no speakers.

Alderman Miller moved to close the hearing, Mayor Pro-Tem Bell seconded.  The motion carried unanimously.

After the first reading was considered the second, Alderwoman Shabazz moved to approve Item #9, Alderman Hall seconded.  The motion carried unanimously.

12. Motion to Approve the Bona Fide Coin Operated Amusement Machine Ordinance (1st and 2nd Reading)

Item #12 is continued to the June 20, 2019 meeting as requested by the City Manager.

13. Motion to Amend the Zoning Ordinance Regarding Nonconforming Uses at 321 Habersham Street (Petitioner: Robert L. McCorkle for Fox and Fig, LLC) (Zoning Hearing)

Mayor DeLoach opened Item #13 (Public Hearing).

Alderman Miller recused himself and left the dais.

Mr. Marcus Lotson, (MPC) began the hearing by introducing Mr. Robert McCoirkle, speaking on behalf of the Petitioner, and Mr. Dana Braun spoke on behalf of the surrounding neighbors.  Mr. McCorkle and Mr. Braun worked together to revise the wording of the alcohol consumption on the Fox and Fig premises.

a.  Alderman Durrence moved to close the hearing, Mayor Pro-Tem Bell seconded.  The motion carried unanimously.

b.  Alderman Durrence moved to approve Item #13 as amended, allowing beer and to extend the hours from 10pm to 11pm, Mayor Pro-Tem Bell seconded.  The motion carried unanimously.

14. Motion to Approve a Transfer of a Class C (Liquor, Beer and Wine) (by the drink) Alcohol License from Joseph Newton to Joseph Barnard of Savannah Post 135 at 1108 Bull Street (Aldermanic District 2)

Mayor DeLoach opened item #14 (Public Hearing).  There were no speakers.

a.  Alderman Durrence moved to close the hearing, Mayor Pro-Tem Bell seconded.  The motion carried unanimously.

b.  Alderman Durrence moved to approved Item #14, Mayor Pro-Tem Bell seconded.  The motion carried unanimously.

15. Motion to Approve a Class C (Liquor, Beer and Wine) Alcohol License with Sunday Sales to Nicholas J. Wilber of The Fat Radish (Aldermanic District 2)

Mayor DeLoach opened item #15 (Public Hearing).  There were no speakers.

a.  Alderman Durrence moved to close the hearing, Mayor Pro-Tem Bell seconded.  The motion carried unanimously.

b.  Alderman Durrence moved to approve Item #15, Alderman Miller seconded.  The motion carried unanimously.

PUBLIC HEARINGS
16. Motion to Approve Cemetery/Burial Ground Land Development Permit for 11305 White Bluff Road

Mayor DeLoach opened item #16 (Public Hearing).  There were no speakers.

Bridget Lidy advised council on the public hearing according to State Law for moving cemetery/burial lots.  

Mr. Lee Cope spoke on behalf of Hutton Development, owners of the property.  Hutton Development hired an archeologist to survey the site and advise on moving the remains.  Hutton Development also hired a genealogist to locate family members, other deceased family, and their burial sites to which the remains will be transferred.  Mr. Daniel Carey of the Historic Savannah Foundation commended Mr. Cope and Hutton Development for their outstanding efforts to work within State Laws to relocate the remains of the burial site.

Mayor and Council thanked all involved for having concern for the families involved.

b.  Alderman Miller moved to approve Item #16, Alderman Foster seconded.  The motion carried unanimously.

Attorney Lovett read O.C.G.A. §36-72-8 for the Mayor and Council when considering the motion. 

ORDINANCES - FIRST AND SECOND READING
17. Motion to Amend the Future Land Use Category of 61 Graham Street (Petitioner: Joshua Yellin for Cardinal Capital Management and Planning Commission)

After the first reading was considered the second, Alderman Johnson moved to approve Item #17, Alderwoman Shabazz seconded.  The motion carried unanimously.

18. Motion to Rezone 61 Graham Street from PUD-M, R-4, and B-G to I-P (Petitioner: Josh Yellin for Cardinal Capital Management)

After the first reading was considered the second, Alderman Johnson moved to approve Item #18, Alderwoman Shabazz seconded.  The motion carried unanimously.

19. Motion to Amend an Ordinance of the City of Savannah Code, Part 7, Chapter 1, Article A, Section 7-1018, Appendix I, Section 208 (Speed Limits for Off-System Roadways)

After the first reading was considered the second, Alderman Durrence moved to approve Item #19, Alderman Miller seconded.  The motion carried unanimously.

20. Motion to Amend an Ordinance of the City of Savannah Code Part 7, Chapter 1, Article A, Section 7-1121, Appendix I, Section 227 (Stop intersection enumerated).

After the first reading was considered the second, Alderman Durrence moved to approve Item #20, Alderman Miller seconded.  The motion carried unanimously.

21. Motion to Amend an Ordinance of the City of Savannah Code Part 5, Chapter 2 (Sewage Collection and Disposal)

After the first reading was considered the second, Mayor Pro-Tem Bell moved to approve Item #21, Alderman Miller seconded.  The motion carried unanimously.

22. Motion to Amend the Zoning Ordinance by Creating the Savannah Harbor Parcel 5 PUD (Petitioner: Joseph R. Ross)

The Petitioner requested a continuance to the July 18 or August 1 Meeting depending on closing date.  No action was taken.

23. Motion to Rezone 0 Resort Drive from PUD-B-W-70 to the Savannah Harbor Parcel 5 PUD (Petitioner: Joseph R. Ross)

The Petitioner requested a continuance to the July 18 or August 1 Meeting depending on closing date.  No action was taken.

24. Motion to Adopt a Resolution Approving the Hudson Hill/Bayview Neighborhood Plan

Alderman Johnson moved to approve Item #24, Alderwoman Shabazz seconded.  The motion carried unanimously.

25. Motion to Adopt a Resolution Requesting that the Georgia Department of Transportation Amend Radar Authorization #042019051 to Provide for Speed Enforcement

Alderman Durrence moved to approve Item #25, Alderman Miller seconded.  The motion carried unanimously.

26. Motion to Adopt a Resolution Limiting Delegation Authority of Contracts

Mayor Pro-Tem Bell moved to approve Item #26, Alderman Miller seconded.  The motion carried unanimously.

27. Motion to Adopt a Resolution Reaffirming the City of Savannah's Ethics Ordinance

a.  Alderman Johnson moved to delay the vote on Item #27 for 2 weeks.  The motion failed for lack of a second.

b.  Alderman Miller moved to approve Item #27, Alderman Hall seconded.  The motion carried, 8-1-0.  Alderman Thomas voted no.

28. Motion to Approve Contract Amendment No. 2 with Perkins + Will for Consulting Services on the Redevelopment and Expansion of Parking In and Around the Canal District (Event No. 6044)

57.  Two City Attorney Items

1.  Request approval to direct the City Attorney to show cause of 1816 Montgomery Street (Marathon gas station) for termination of alcohol license .

Alderman Miller moved to approve Item #1, Alderman Foster seconded.  The motion carried unanimously.

2.  Request approval for the City Attorney to make a settlement - Stewart matter, police chase down Presidents Street $180,000.

Alderman Miller moved to approve Item #2,  Alderman Hall seconded.  Alderman Durrence did not vote.  The motion carried.

Alderman Durrence left at 3:12 p.m.

28.  Motion to Reappointing Lowell Kronowitz to the  Savannah Airport Commission.
