Description

Petitioners Jane and Ed Feiler request the western half of the unopened section of Pickett Street adjacent to the east side of their property, 330 Lee Boulevard, be abandoned and available for sale. Pickett Street is a 60-foot-wide, unopened right-of-way in the Habersham Woods neighborhood that runs from Lee Boulevard to Johnston Boulevard. The property owner has submitted a survey with the 30-foot, 0.079-acre portion of Pickett Street abutting their property they would like to acquire.

This petition has been reviewed by Development Services, the Greenscapes Division, Public Works and Water Resources, and Real Estate Services. The following conditions are noted:

  • The City has a sanitary sewer line in the unopened right-of-way. Said sanitary sewer line shall be field located and shown on a property plat to be ordered by Petitioner.
  • Any transfer of property shall include a utility easement of no less than 15 feet in width and centered on the existing sanitary sewer line.

Georgia Code 36-37-6(g) states that the City is able to declare surplus unneeded right-of-way and offer it for sale to abutting landowners.  Staff recommends declaring the entire length of Pickett Street between Lee Boulevard and Johnston Boulevard as surplus and available for sale to adjoining property owners. If approved, staff will contact adjoining property owners and fair market value will be established and utilized for negotiations with property owners.
