49. Authorize the City Manager to Declare a .04 Acre Portion of Sugarberry Street as Surplus and Available for Sale (Petition #22-023).

Description

Petitioner Gary Wiggin, on behalf of Highland Park Commercial, LLC (HPC), has requested the Mayor and Council declare surplus and available for sale 0.04 acres of the unopened and unimproved right-of-way of Sugarberry Street. HPC owns the properties along either side of Sugarbery Street. The total land area to be sold comprises +/-0.04 acres and was recently appraised at a current market value of $20,000.

Georgia code 32-7 provides authorization for the Mayor and Council to declare unneeded Right-of-Way (ROW) surplus and available for sale to adjoining property owners so they may assemble it with their adjoining properties and develop that property at its highest and best use. HPC is the sole adjoining property owner. HPC will be responsible for all costs associated with the proposed real estate transaction. The sale will generate revenues for the general fund and also reduce maintenance costs associated with mowing and securing these unopened and unimproved rights-of-way.

The petition has been reviewed and approved by Development Services, Public Works and Water Resources, Park & Tree, Planning and Urban Design, and Real Estate Services, and subject to the following condition:

An archeological assessment, as outlined in City Ordinance Sec 8-13006, shall be conducted prior to sale of the property. HPC must plat and relocate any public and private utilities in the sections of Sugarberry Street at its sole expense, subject to approval of such utility relocations by the City in its sole discretion.

Additionally, authorization for the City Manager to execute a deed and associated closing documents to sell the designated rights-of-way at the appraised value of $20,000 is requested.
