Description

The petition of Dana Braun (Agent) on behalf of 42/43 LLC (Owner) is for a special use permit to sell alcohol by the drink in association with a restaurant located at 9 West 43rd Street (PIN 20074 24002). The parcel is located in the TC-1 (Traditional Commercial-1) zoning district which was established to ensure the vibrancy of historic mixed use neighborhoods with traditional development patterns characteristic of Savannah during the streetcar and early automobile eras. The district provides for commercial areas that are developed at a mass and scale harmonious with nearby residential neighborhoods.  Restaurants are a permitted use in the TC-1 zoning district, yet a special use permit is needed to sell alcohol from restaurants in this zoning district.

The subject property is located in the evolving area of the Metropolitan Neighborhood and Streetcar Historic District popularly known as Starland between Bull Street, Victory Street and Whitaker Street. In 2017, the property expanded with the recombination of two lots (17-006816-SUBP) which created a 11,530 square foot lot. A vacant, two-story residential structure on the site is currently undergoing renovations to house a restaurant/coffee shop.

TC-1 is a zoning district that permits a mix of residential and commercial uses given they meet certain criteria. The addition of a commercial-use restaurant with alcohol sales to this immediate area is not likely to disrupt the existing character of the area.

Recommendation

The Planning Commission recommends approval of the special use permit for a restaurant with alcohol sales at 9 West 43rd Street under the following conditions:

  • The restaurant only operate between the hours of 7:00 a.m. and 10:00 p.m.
  • The overflow parking area provide a minimum of five (5) parking spaces.
