Description

This zoning hearing was continued from the July 5, 2018 City Council Meeting.

Petitioner Robert L. McCorkle for Patrick All (File No. 18-002315-ZA) is requesting approval of a rezoning map amendment for properties located at 2824 and 2830 Dixie Avenue at the intersection of Dixie Avenue and Kerry Street from the existing R-6 (Single Family Residential) Zoning District, to a B-C (Community Business) classification. The subject site consists of two residential lots, each of which is 60 feet in width and 150 feet in depth for a total lot area of 9,000 square feet for each lot. The subject property has been in the R-6 Zoning District since adoption of the current Comprehensive Zoning Ordinance by the City in 1960.

The proposed B-C zoning classification is designed to accommodate the widest variety of commercial uses in the ordinance, including retail, restaurant, sales and service. Typically, this zoning district would be found adjacent to a major arterial street within a commercially developed area.

MPC staff found that in the case of the petitioner’s property, although commercial zoning and some commercial uses are present, this area has yet to become a commercial center, though such a transition is likely in the future. MPC staff recommended a more comprehensive approach to rezoning on Dixie Avenue, as was achieved west of Dixie Avenue.

The Planning Commission heard the rezoning petition at its June 5, 2018 Regular Meeting. However, this petition is submitted without a recommendation because an even number of commissioners voted and two votes resulted in a tie.
