Motion to Amend the Zoning Ordinance Regarding Residential Uses and Density, Alternative Planning Commission Recommendation (Petitioner: Harold Yellin for Midtown Redevelopment, LLC)
Description

The Mayor and Aldermen approved this text amendment request following a zoning hearing at the December 21, 2017, City Council Meeting.  The action being considered now is the approval of an ordinance to allow certain residential uses by-right and to increase residential density (File No. 17-004803-ZA).

In addition to the proposed text amendment, the petitioner also seeks a related rezoning to the 3-B district. The rezoning petition is scheduled for the same City Council meeting as the rezoning petition (File No. 17-004805-ZA).

On November 21, 2017, the Planning Commission voted to recommend approval of an alternate amendment than originally proposed by the petitioner. Though not consistent with the original request, the property owner supports the Planning Commission’s recommendation.  The alternate amendment amends the Victorian PNC District (Sec. 8-3028) and the Mid-City District (Article K):

1) To allow certain residential uses by-right; and

2) To increase residential density, specifically for properties within the Martin Luther King Jr. / Montgomery St Urban Redevelopment Area.
