Attorney Wallace Williams, on behalf of his client Richard Lane, has petitioned to have the City quitclaim its rights to the western 30’ portion of the undeveloped 60’ Battey Street located directly adjacent to Mr. Lane’s property at 207 Johnston Street in the Habersham Woods neighborhood.

Mr. Lane purchased 207 Johnston Street in 2019 and has recently filed a Recombination Survey with Development Services to incorporate the western 30’ portion of the undeveloped Battey Street into his property. Upon review of title, it was found that the original developer of the neighborhood retained certain rights to the streets and lanes of the Habersham Woods neighborhood and never dedicated them to the City. Therefore, the City does not have legal ownership, but does have a utitlity easement over the eastern 10 feet of the undeveloped right-of-way.  A quitclaim deed from the City would allow Development Services to continue processing the requested survey and clear title to this area of land.  The City will retain the 10’ utility easement so as to access and maintain a stormwater line running along the eastern edge of this property.

This petition has been reviewed by Development Services, Planning and Urban Design, Public Works and Water Resources, Greenscapes, and Real Estate Services.
