August 31, 2017 City Council Regular Meeting
Title
Motion to Approve Intergovernmental Agreement for Adjustment of 48-inch-diameter Industrial and Domestic (I&D) Water Main on Brampton Road
Description

The Georgia Department of Transportation (GDOT) is planning to install a new rail spur and a new Brampton Road Connector from Burnsed Boulevard running northeast and tying it to Brampton Road (see attached exhibit). The new construction will be in conflict with the existing 48-inch-diameter Industrial and Domestic (I&D) water line and will need to be relocated.

This project has been designated as a Public Interest Determination (PID) project. Per Official Code of Georgia Annotated (OCGA) 32-6-170 & 171 under Senate Bill 19, when it is in the best interest of the public, the Department is authorized to pay or participate in the payment of the cost of removing, relocating, or making necessary adjustment of the utility facilities in order to expedite the staging of an active construction project as long as the facilities are included as part of the contract between the Department and the Department’s roadway contractor.

To start this process, an executed Memorandum of Understanding (MOU) is needed to establish the procedures for removing, relocating, or other necessary adjustments of the utility facilities. The attached MOU clearly delineates the sole responsibility of GDOT for the engineering design and construction cost.
